Kings Point Membership Group Hires Legal Firm for Clarification of Florida’s Condominium Law

Fed up with Kings Point’s ‘attorney of record” interpretation of the current recall procedures regarding the recall of Directors Cliff Seder and Paul Hunt, and the misinterpretation of KP’s By Law’s, a group of Kings Point members have hired a Tampa legal firm, whose practice involves condominium law interpretation and representation in Florida. The group is requesting a clarification of Florida’s Condominium Law as it pertains to Kings Point.
            During a Special Board Meeting held on January 29, the subject was posed to Federation President Cliff Seder, if the ‘attorney of record” consulted the state’s condominium law, to which Seder replied that Kings Point does not fall under Florida’s Condominium Law.
            The following is an email sent by the group and obtained by SCC Free Press.

Dear Fellow Residents,
During last Friday’s  Federation Special Board of Directors meeting the Seder-Block-of -Votes pushed through a motion to obtain legal counsel to develop and execute a recall process and another motion to assess the entire community for all costs relating to the first motion. All the while, disregarded the strong opposition in the room. President Seder and his supporters would have you believe that the “few” who initiated a recall are responsible to all of you for bringing these board “decisions” upon you. He further would have you believe that our current By Law regarding recall of Directors is deficient.     Further, he ignores that our community pays significant monies to our Property Management Company to “manage and support” as directed by our Board. Nothing in their contract says “except in the case of a recall.”
            There are many concerned residents who believe it is past time for us to seek our own legal counsel and opinions. Therefore we have retained a Tampa Law Group who specializes in Condominium Law to review our Governing Documents, Articles of Incorporation, By-laws, Administrative Codes, and Operational Procedures, and advise any areas that are in fact inconsistent with state statutes, ambiguous, invalid, or deficient. We are also seeking counsel to advise us of our position to file an injunction against any further action by this Board until it has been determined whether any By-Laws have been violated during their term of office. 
                We are therefore asking for voluntary contributions to support a legal fund to defend the residents of Kings Point from any further violation of our rights by the current board members. We have an estimate of $3000 to $5000 to be sufficient to accomplish the above goals. A Kings Point Residents Legal Defense Fund has been established at the Wachovia Bank at 674 & Pebble Beach. Chili Cookers and Flea Market Vendors Needed
Chili cookers and flea market vendors are needed for the Annual Chili Cook-off and Flea Market on Saturday, February 20 at E.G. Simmons Park in Ruskin. The event is hosted by the Hillsborough County Parks, Recreation and Conservation Department.
            There is no entry fee for chili cookers, but contestants need to prepare at least 5 gallons of their favorite chili. Attendees may purchase a bowl for $3 to taste the various chili recipes and vote for their favorites. Tasting and judging begins at noon. Cookers compete for cash prizes paid out to the top three chili recipes as well as a trophy for the best decorated booth. Cookers also compete for the Phil Rogers Trash Talking Award, a friendly banter among the chili contestants trash talking competitor’s homemade chili.
            Flea market vendors will be selling their goods at the outdoor market. The cost is $12 for a 12 X 12 space. Vendors must provide their own tables and may rent more than one space. The flea market opens at 8 a.m.
            Proceeds from the $12 vendor space rental and $3 chili bowl benefit the Friends of the County Parks, a 501 (3) (c) not-for-profit group that promotes financial and community support to the Hillsborough County Parks, Recreation and Conservation Department.
            This year’s event will also feature a Classic Car Show which begins at 10 a.m.
Applications for chili cookers and flea market vendors are available on the Parks website at www.hillsboroughcounty.org/parks. Look under upcoming events/registration for information. There is a $2 park entry fee per car load of up to eight persons for the event. Call the park at (813) 671-7655 for additional information.

It's Official! Golf Carts To Wal*Mart Path Grand Opening Ceremony March 9, 2010; After 2½ Years and 4,400 Signatures, Golf Cart Access to Wal*Mart Is Here

“Cart path is their road to freedom” reads the headline on an article in the St. Petersburg Times. The dateline is December 18, 1999. The story chronicles the dedication of a golf cart path to the former Walmart store on the west side of Sun City Center.
            Ten years later, plans are in the works for another dedication ceremony for another golf cart path. This one will provide access to the new Wal*Mart Supercenter just across US 301 on the east side of SCC. Actually, that store will be three years old this April, but it was new when work began on a campaign to get the path.
            Today, the project has the blessing of county and state officials, and work is well underway on the path that will carry golf carts from East Del Webb Blvd. to the traffic signal where they will soon be allowed to cross US 301 to the store.
            The County Department of Public Works expects to complete its work within a matter of weeks. Work remaining to be done includes completion of the crushed-asphalt surface, installing golf-cart-only barriers and “Golf Cart Crossing” signs on US 301, and any other required safety provisions. The speed limit on US 301 will be reduced from 55 mph to 45 mph in the area.
            The path will provide a pleasant, tree-shaded 800-foot drive through a wooded area to the crossing. Eventually, the site is expected to house office buildings as the adjacent Commonwealth Plaza expands.
IT IS NOT YET LEGAL TO CROSS US 301 IN A GOLF CART!
Do not attempt to drive your cart to Wal*Mart until the work is done and the crossing is officially approved and opened.
 
Sun City Center Security Patrol to Hold Annual Meeting;
Patrol to Vote on By-Law Amendment and Board of Directors

The Sun City Center Security Patrol holds its Annual Meeting on Friday, February 5 at 9:00 a.m. at Community Hall. All Security Patrol Members are urged to attend as new business will be voted upon. Coffee and Danish will be served at 8:30 a.m.
By-Law Amendment
            A proposed By-Law will be on the slate. The current Board voted to place the amendment on the slate. It reads:
PROPOSED AMENDMENT TO BY-LAWS
ARTICLE III – CHIEF OF PATROL
Section 1. Election
The last sentence of this paragraph, which reads: “the term of office will be for two years.” shall be deleted. The following will be added:
The term of office will be for two years, which may be extended for another term of two years with the vote of the Captains. The Chief of Patrol may not serve more than two consecutive terms. The current Chief of Patrol is excluded from this amendment.
Election of Directors
            The SCC Patrol has 9 volunteer board of directors who serve a 2-year term. After completing a first term, directors have the option to run for another term. A board director can only serve 4 consecutive years with the exception of treasurer (Al Hamm) and Chief of Patrol Martha Finley.
            This year’s election has six candidates running for election, the largest number of candidates to run for a seat on the Board. Of those six candidates, only four can be elected. Board President Bill Dauber and director term limit expires, while Mike Albanese is running for his second term and Al Hamm his fifth.

SIXTH ANNUAL ALZHEIMER’S EDUCATIONAL
SEMINAR FEBRUARY 11
The Samaritan Alzheimer’s Auxiliary of Sun City Center invites you to be their guest at its sixth Annual Alzheimer’s Educational Seminar of February 11 at the SCC Community Hall, 1910 S. Pebble Beach Blvd. in Sun City Center. The seminar runs from 9:00 a.m.-3:30 p.m. and is an educational program on medical, social and research updates of Alzheimer’s disease.
            Speakers, who have generously donated their time, will be Amanda Smith, MD; Huntington Parker, Ph.D.; Eric Pfeiffer, MD; Sutith Idiculla, RPH Pharmacist; James Eggert, Esq., Elder Law; Eileen Pawley, MS; and Moderator Patricia Suarez.
            A complimentary breakfast, lunch, and snack, is provided through a grant from The Community Foundation of Greater Sun City Center’s “Give a Little Back-Spirit Fund.” There is not cost for the seminar, adult day care, or Alzheimer’s patient. Sun City Center Security Patrol Board President Finishes Term

SCC Security Patrol Board President Bill Dauber gaveled his final board meeting on Tuesday, January 12, 2010. Dauber took over the president position from Ann Shepherd three years ago.
            Captain of Team 10 for 7 years, Dauber has been with the Patrol for 8 years. The past five years, Bill headed up the annual SCC Golf Cart Inspection.
            Dauber also is a six year member of the Hillsborough County Sheriff’s Department with a rank of Reserve II Corporal. The Security Patrol Board will
elect a new president in February.
